Terms of Use
Terms of Use · Version 3.0 · In force from [[OWNER: effective date]] Previous version: 2.0 (28 September 2026), kept at brightnods.co.uk/terms/archive/. What changed is at the end.
1. Key points
This box is a summary. The full terms follow, and they are what count.
- Who we are: KINDHOME LTD, trading as BrightNods, a company registered in England and Wales (No. 17558840). 32 Mill Street, Worcester, WR1 2NH. Email [[OWNER: support email]], telephone [[OWNER: phone]]. See section 19.
- Who it is for: families in the UK with children aged 5 to 11 (Years 1 to 6). A parent or carer holds the family account and agrees to these terms. Children use BrightNods under that grown-up's account.
- Free version: three quizzes a day on each device, at no charge (section 5.1 lists what counts as a quiz). Lessons and reviewing mistakes are not limited.
- BrightNods Premium: an optional monthly subscription at [[OWNER: price]] a month including VAT. It removes the daily limit, so all quizzes are unlimited. Free use already includes every subject and year group. Eligible new subscribers get a free trial of [[OWNER: trial length]], then pay [[OWNER: price]] a month. It renews automatically every month until you cancel. Sold and billed by Apple.
- Cancelling: at any time on your iPhone or iPad in Settings > your name (Apple Account) > Subscriptions, or with Manage subscription in the grown-ups' area of the app (in Settings, or on the Premium screen). Cancel at least 24 hours before the trial or the current month ends to avoid the next payment. Deleting the app or your account does not cancel it.
- Your 14-day right to cancel and refunds: see section 6. Apple takes payments and handles refunds: ask Apple at reportaproblem.apple.com. If you contact us, we will reply with the steps and support your request. Your legal rights are not affected.
- Your information: we cannot see your family's information in the app. It stays on your devices and, only if you switch it on, in your family's iCloud. Deleting the app does not delete the iCloud copy (section 9). See our Privacy Notice.
- Family sharing: you choose who sees each child's progress. You can report a concern to us (section 10.6).
- If something goes wrong: tell us at [[OWNER: support email]]. You have legal rights if the app is faulty (section 12).
2. About these terms
2.1 These terms are an agreement between you and KINDHOME LTD, trading as BrightNods ("we", "us"). "You" means the parent or carer who sets up BrightNods and holds the family account.
2.2 You accept these terms when you create your family account, by ticking to agree after you have had the chance to read them. You do not accept them just by opening the app. If you do not agree, please do not set up an account; you can delete the app.
2.3 Children cannot enter into this agreement. They use BrightNods under your account and with your permission. You are responsible for deciding whether, and how, your children use it.
2.4 These terms are also BrightNods' End User Licence Agreement on the App Store (see section 17).
2.5 How we use information is explained in our Privacy Notice (brightnods.co.uk/privacy/), and for children in Your BrightNods and you. They are not part of this agreement, but please read them.
3. Who can use BrightNods
3.1 BrightNods is made for children aged 5 to 11 (Years 1 to 6) in the United Kingdom. It is offered in the UK App Store only.
3.2 Who holds the account. The family account is held by a grown-up, never by a child. The person who sets it up and agrees to these terms must be an adult (in the UK, 18 or over) who has parental responsibility for each child they add, or the permission of someone who has. This is a rule about who holds the account. It is not an age limit for using BrightNods: children aged 5 to 11 use it under the grown-up's account, with their permission.
3.3 Children cannot set up their own accounts. A grown-up adds each child in the grown-ups' area. BrightNods cannot be used without a family account.
3.4 Who counts as the parent. The person who signs in with Sign in with Apple, using their own adult Apple Account, and creates the family account is treated as the parent, or the person with parental responsibility, for each child they add. By adding a child you confirm that you have parental responsibility for that child, or the permission of someone who has it. You decide which children are added and which child uses the app. We rely on your confirmation; we do not ask for identity documents (our Privacy Notice, section 4, explains why).
4. What BrightNods is and what you need
This section, with sections 5, 6 and 19, gives the information the law requires before you buy (Consumer Contracts Regulations 2013, Schedule 2). It forms part of these terms.
4.1 What it does. BrightNods is a practice app for primary-school maths, English, spelling, phonics and other subjects, following the National Curriculum in England. It includes quizzes, short lessons, times tables, practice versions of the Multiplication Tables Check, Phonics Screening Check and SATs-style papers, spelling practice, homework practice, a working-out page where children can draw and write their working, and a grown-ups' area to follow progress and set practice. Children earn points, levels, streaks and stickers by practising. They choose the stickers they want, each at a fixed points price. They can also look after a pet and choose a buddy to learn with. No reward depends on chance, and rewards cannot be bought with money.
4.2 Devices. iPhone and iPad running iOS or iPadOS 17 or later. Some features need more:
- the homework helper's suggested answers need a device that supports Apple Intelligence, running iOS 26 or later, with Apple Intelligence switched on;
- voice answers ("talking answers") need a device that can recognise British English speech on the device itself;
- iCloud sync and family sharing need an Apple Account signed in to iCloud, with enough iCloud storage;
- family sharing needs each person to have their own Apple Account.
4.3 Internet. Once it is installed and you have signed in, BrightNods works without an internet connection. Signing in, iCloud sync, family sharing, and buying and restoring Premium need a connection.
4.4 Built-in protections. The grown-ups' area is locked with a parent PIN. You must choose the PIN when you set up the app, before you add a child. Buying, sharing, the camera and links that leave the app need a grown-up to answer a question or enter the PIN first. Children never see prices, offers or messages asking them to buy anything, or to ask you to buy it: when the daily allowance is used up, a child is told to come back tomorrow. Free use has a daily allowance (section 5.1).
4.5 Your legal rights. BrightNods must be of satisfactory quality, fit for purpose and as described. Section 12 explains this.
4.6 How to complain. See section 16.
4.7 Who you buy Premium from. Premium is sold through the App Store by Apple Distribution International Ltd ("Apple"), which takes payment and handles cancellations and refunds under the Apple Media Services Terms and Conditions. We provide BrightNods and Premium and are responsible for them (sections 12 and 17). Our name, address and contact details are in section 19.
4.8 The total price. The price of Premium is shown in the app before you buy and includes VAT. We make no other charge. Your mobile or broadband provider may charge you for data.
5. Free use and BrightNods Premium
5.1 Free version. Without Premium, a child can start three different quizzes a day on each device, at no charge. The quizzes that count are: topic quizzes; the end-of-year Big Test; practice set by a grown-up (including homework practice); and the special practice modes (Times Tables, Mental Maths, SATs-style practice, past papers, and the Multiplication Check and Phonics Check practice). A quiz counts once when it is started (looking at a quiz's start page without starting it does not count), and going back to the same one again that day does not count again. Lessons and reviewing mistakes are not limited. Each iPhone or iPad has its own allowance; it is not shared across your family's devices. The allowance starts again each day at midnight by your device's clock (UK time on a device set to the UK). Changing the device's clock does not start a new allowance early.
5.2 What Premium includes. No daily limit: every quiz listed in section 5.1 is unlimited, in every subject and for every year group, on every device where you are signed in to the same Apple Account, and for the family members covered by section 5.4.
5.3 Price and trial.
- Premium is a monthly subscription. In the UK it costs [[OWNER: price]] a month, including VAT. The Premium screen in the grown-ups' area shows the price from the App Store, and Apple shows it again before you confirm.
- If you are eligible, Premium starts with a free trial of [[OWNER: trial length]], then costs [[OWNER: price]] a month. Apple decides who is eligible; usually each Apple Account can have only one free trial of BrightNods Premium. The Premium screen shows the trial only if you can have it. If you cancel at least 24 hours before the trial ends, you pay nothing. If you do not, the first monthly payment is taken when it ends and the subscription carries on monthly.
5.4 Sharing Premium with your family. Premium can be shared through Apple Family Sharing with up to five other people in your Apple Family Sharing group, at no extra cost. We have switched on Family Sharing for BrightNods Premium, and Apple does not let us switch it off again. You control whether your subscriptions are shared with your family group in your Apple Account's Family Sharing settings. Premium does not pass to people outside your Apple Family Sharing group, even if you invite them to see a child's progress through BrightNods family sharing (section 10.4). They can buy their own subscription.
5.5 Automatic renewal and how to cancel.
- Premium renews automatically every month and Apple charges the payment method on your Apple Account, unless you cancel at least 24 hours before the end of the current month (or trial).
- You can cancel at any time:
- in the app: grown-ups' area > Settings > Manage subscription, or Manage subscription on the Premium screen; or
- on your iPhone or iPad: Settings > your name (Apple Account) > Subscriptions > BrightNods; or
- as Apple explains at support.apple.com/118428.
- When you cancel, Premium carries on until the end of the period you have paid for, then stops. Your child's progress is kept and the free allowance applies again.
- Deleting the app, or deleting your BrightNods account, does not cancel the subscription. Please cancel it as above.
5.6 Price changes. If we change the price, Apple will tell you before it applies, as its rules require, and for an increase it may ask you to agree. You can cancel before the new price applies and you will not pay it. A price change never applies to a period you have already paid for.
5.7 Telling us you want to cancel. Apple controls billing, so we cannot cancel a subscription for you. If you tell us, by email to [[OWNER: support email]], that you want to end Premium, we will reply promptly with the steps to cancel (section 5.5) and, if you want one, to ask Apple for a refund (section 5.8), and help you until it is done.
5.8 Refunds. Apple takes the payments for Premium and handles refunds, as it does for every App Store subscription. To ask for a refund, go to reportaproblem.apple.com, sign in with the Apple Account that paid, and choose BrightNods Premium; or contact Apple Support. Apple decides refund requests under its own terms. If you contact us at [[OWNER: support email]] about a refund, we will reply with these steps and support your request to Apple. You keep your legal rights:
- you may cancel a new subscription within 14 days and get your money back, unless that right has ended early (section 6);
- if BrightNods is faulty, you may be entitled to a repair, replacement, price reduction or refund (section 12);
- if we close BrightNods or remove a main Premium feature during a period you have paid for, see sections 13 and 15.
5.9 New UK rules for subscriptions. New UK rules on subscriptions (in the Digital Markets, Competition and Consumers Act 2024) are expected to apply to subscriptions that start on or after 1 January 2027. Until they apply to your subscription, sections 5 and 6 describe your rights. If they apply to your subscription, you also have the rights they give you, and nothing in these terms takes those rights away. In particular:
- Reminders. You will be sent a reminder before a free trial ends and the first payment is taken, and a reminder every 6 months while you subscribe, saying what you pay and how to cancel. Reminders may come from Apple. BrightNods also shows them in the grown-ups' area of the app (Settings > Subscription), and as a notification on your device if you allow BrightNods' notifications.
- Cooling-off after a free trial. For 14 days after a free trial turns into a paid subscription, you can cancel and get that payment back. Section 6.4 already gives you this, in full.
- Ending easily. You can end Premium online in a few steps (section 5.5). If you tell us you want to end it, we will help you (section 5.7).
6. Your 14-day right to cancel
6.1 When you start a Premium subscription you have a legal right to change your mind and cancel within 14 days, without giving a reason, and get a full refund, unless the right has ended early (section 6.3). For App Store purchases in the UK this right is given and handled by Apple (Apple Distribution International Ltd), which sells the subscription. Under Apple's terms the 14 days run from the day Apple sends your receipt, and the right applies when a subscription starts, not to each monthly renewal.
6.2 How to cancel within 14 days. Use "Report a Problem" at reportaproblem.apple.com, or your Apple Account purchase history, and choose to cancel or withdraw the purchase. You can also email Apple at rightofwithdrawal@apple.com. Apple will refund you. Please also cancel the subscription (section 5.5) so it does not renew.
6.3 When the 14-day right ends early. Premium is digital content that starts as soon as you buy it. Your right to cancel ends before the 14 days are up only if all three of these happen:
- (a) you ask for Premium to start straight away, before the 14 days are over;
- (b) you confirm that you understand you will lose your right to cancel once it starts; and
- (c) you are sent confirmation of this in a form you can keep.
Before you buy, the Premium screen shows you this choice, with the box not ticked: "Premium starts straight away. I agree, and I understand that I will lose my 14-day right to cancel once it starts." You need to tick it to buy, because Premium starts as soon as Apple confirms the purchase. After you buy, the app shows you a confirmation of what you agreed to, with the date, the price and the version of these terms, and you can save a copy of it. Apple also sends you a receipt. If any of (a), (b) or (c) did not happen, your 14-day right continues and you can cancel as in 6.2. If your subscription started with a free trial, section 6.4 gives you more.
6.4 Free trials. If you cancel at least 24 hours before a free trial ends, you pay nothing. If you do not cancel, your first payment is taken when the trial ends. If your subscription started with a free trial, you can cancel within 14 days of your first payment and get that first payment back in full, even if you ticked the box in section 6.3. Ask Apple as in section 6.2. If you contact us, we will reply with the steps and support your request (section 5.8). Please also cancel the subscription (section 5.5) so that it does not renew.
6.5 Losing the 14-day right does not affect your rights if BrightNods is faulty or not as described (section 12).
7. Your account
7.1 Family accounts use Sign in with Apple. Keep your device, Apple Account and parent PIN secure. Do not share your PIN with children. Tell us if you think someone has used your account without permission.
7.2 You can correct your family's details, export your information, and delete your account at any time in the grown-ups' area: Settings > Privacy and data > Manage your data. Deletion happens 30 days after you ask, so you can change your mind; you can also choose to delete straight away. iCloud sync and family sharing stop as soon as you ask. Keep BrightNods on the device until the deletion is done, or the copies in your iCloud are not removed (you can then remove them in Settings > your name > iCloud). Deleting removes your family's information as described in the Privacy Notice (section 8 there). At present it does not stop BrightNods using your Apple Account: our small revocation service (which keeps nothing) is not switched on yet, so the app sends nothing to Apple. To stop BrightNods using your Apple Account, open Settings, tap your name, then tap Sign in with Apple. Choose BrightNods, tap Delete, then tap Stop Using. On iOS 17, go to Settings > your name > Sign-In & Security > Sign in with Apple, choose BrightNods and tap Stop Using Apple ID. The app shows you these steps once, when the deletion is carried out.
7.3 Deleting your account does not cancel Premium. Cancel it as in section 5.5.
7.4 Signing out deletes nothing. Your family's information stays on the device until you delete it.
8. The learning content and the homework helper
8.1 BrightNods' questions, answers, explanations and lessons are written with the help of AI tools and checked for accuracy against the National Curriculum in England. Checking cannot catch everything, and we correct mistakes we find. The content must be as described and of satisfactory quality (section 12), and this section does not reduce that.
8.2 BrightNods is a practice tool. It supports, but does not replace, your child's teacher and school. Practice papers are in the style of national tests but are not official papers, and we cannot promise any particular test result or school outcome.
8.3 If you think a question, answer or explanation is wrong, please tell us at [[OWNER: support email]]. We will check it and fix it in an update if it is wrong.
8.4 Homework helper. When a grown-up photographs a homework sheet, BrightNods reads the text on the device and, on supported devices, Apple's on-device AI can tidy the questions and suggest answers. Nothing is sent off the device. Text read from a photo and AI suggestions can be wrong. That is why a grown-up must check and confirm every answer before it is used. We are responsible for the app working as described, including the homework helper. We are not responsible for what is on your child's homework sheet. Because the app tells you that suggestions can be wrong and asks a grown-up to check them, a wrong suggestion that a grown-up confirms is not by itself a fault in the app. This does not affect your rights in section 12.
8.5 Your own content. Spelling lists, homework questions and practice you add belong to you (or to whoever wrote them, such as your child's school). You give us no rights in them: they stay on your devices and, if you switch on iCloud sync or family sharing, in your family's iCloud. Please only add material you are allowed to use for your family's own practice.
9. Your family's information
9.1 We don't run servers that store your family's information; one small service, when it is switched on (it is not switched on at present), exists only to cancel your Sign in with Apple login when you delete your account. Your family's information is kept on your devices. We cannot see it and hold no copy. The Privacy Notice explains this in full, including how long things are kept.
9.2 iCloud sync and family sharing are off until you switch them on.
- iCloud sync copies your family's BrightNods information to the iCloud account signed in on the device. Children's progress, badges, stickers and points are included; the pet and working-out pages stay on the device.
- Family sharing shares the children you choose with the people you invite, through the iCloud of the grown-up who set it up (section 10.4).
- If you switch on either, Apple's iCloud terms also apply to your iCloud account.
9.3 Deleting the app is not the same as deleting your information.
- Deleting the app removes the copy on that device only.
- With iCloud sync on, the copy in iCloud stays until you delete it in the app (section 7.2) or in Settings > your name > iCloud. If you install BrightNods again and switch iCloud sync back on, progress, badges and stickers come back. A profile you have deleted, or asked to delete, never comes back.
- Switching iCloud sync off stops new copying. It does not delete what is already in iCloud; you can delete that in the app or in Settings.
10. Using BrightNods fairly
10.1 Please use BrightNods for your family's own learning, not for a business, school or tutoring service.
10.2 Please do not:
- copy, sell, publish or share BrightNods' questions, lessons or illustrations outside the app;
- try to get around the parental gate, the PIN, the daily allowance or Premium, or help a child to;
- take the app apart, change it, or use automated tools to extract its content, except as the law allows;
- use BrightNods in a way that breaks the law or harms anyone.
10.3 Children's safety. Grown-ups should not share their PIN with children, and should keep purchases and sharing in the grown-ups' area.
10.4 Family sharing of progress. Family sharing is off until you switch it on, and you choose it for each child. If you use it:
- invite only people you trust to see and help with your child's learning, such as another parent, a guardian, a grandparent or your child's own device. Every person you invite can see and change the shared information for the children you choose;
- only add and share a child if you are their parent or carer, or have the permission of someone who is;
- only the people you invite can join. Check the list of members in the grown-ups' area from time to time and remove anyone you do not recognise;
- family sharing carries learning progress (including recent wrong answers and the correct answers), how your child said they felt, and the practice you set, as the Privacy Notice (section 6) lists. It carries your child's first name and year of birth, but not the month or day of birth;
- working-out pages (your child's drawing, the question and their answer, from finished quizzes) are shared only if you agree to it for that child;
- grown-ups can react to working out with a sticker or a phrase from a fixed list. Nobody can type their own message, and family sharing carries no photos, voice or chat. Reactions are deleted after 60 days;
- your child sees a note on their home screen that their grown-ups can see how they are doing;
- you can remove a member, stop sharing a child, or leave or stop family sharing at any time. When the grown-up who set up family sharing stops it, everything shared is deleted. When someone else leaves, the progress summaries, working out and reactions their device shared are removed; the children's profiles and the practice set for them stay with the family (to remove a child, delete the child).
10.5 If someone seriously or repeatedly breaks this section, see section 15.3.
10.6 Reporting a concern. If something shared through BrightNods worries you, for example someone in your family sharing you do not recognise, or a drawing or reaction that seems wrong:
- remove the person or stop sharing straight away in the grown-ups' area. That takes effect at once;
- then tell us at [[OWNER: support email]], with "Concern" in the subject, or use Report a concern in the grown-ups' area (in Settings, on the Family screen, or under a shared page of working out), which starts the email for you. We will acknowledge it within 5 working days, look into it, and tell you what we have done and what you can do next. We cannot see what your family shares, so we will not ask you to send us your child's information;
- if a child is in immediate danger, call 999.
Children are told in the app to stop and tell a grown-up if anything worries them.
10.7 How family sharing is kept safe. Only people a grown-up invites can join, and members can be removed at any time. There is no free-text messaging, no photos and no chat, and reactions come from a fixed list. Nothing is shared with anyone except the people you invite, and nothing is shared publicly. We will check these protections whenever we change family sharing.
11. Ownership and your licence
11.1 BrightNods, including its questions, explanations, lessons, characters and illustrations, belongs to us or to people who have given us permission. Curriculum and past-paper material is Crown copyright, used under the Open Government Licence v3.0. Other credits are in the app under About.
11.2 We give you a personal, non-transferable licence to use BrightNods for your family's own, non-commercial learning, on Apple-branded devices that you own or control, as allowed by Apple's Usage Rules in the Apple Media Services Terms. Members of your Apple Family Sharing group may also use it as those rules allow.
11.3 You may not rent, lend, sell, sublicense or redistribute BrightNods, except as Apple's Usage Rules allow.
12. Our responsibility to you
12.1 Your legal rights. Under the Consumer Rights Act 2015, BrightNods (including Premium and every update) must be of satisfactory quality, fit for purpose and as described, including as described in the App Store and in the app before you bought. If it is not:
- you can ask us to repair or replace it (for example, fix it in an update) within a reasonable time;
- if that is not possible or does not happen in a reasonable time, you can ask for a price reduction, which can be a full refund. Refunds of payments are made through Apple (section 5.8);
- if BrightNods damages your device or other digital content because we did not use reasonable care and skill, we will repair the damage or pay you fair compensation.
Nothing in these terms affects these rights. Citizens Advice (citizensadvice.org.uk, 0808 223 1133) can tell you more, and in Scotland, consumeradvice.scot.
12.2 What we do not limit. We do not exclude or limit our responsibility for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- your rights under the Consumer Rights Act 2015 described in 12.1; or
- anything else that the law does not allow us to exclude or limit.
12.3 Losses we are responsible for. If we break these terms or fail to use reasonable care and skill, we are responsible for loss or damage you suffer that is a foreseeable result. Loss or damage is foreseeable if it was obvious it would happen, or if both of us knew it might happen when you agreed to these terms.
12.4 Losses we are not responsible for. We are not responsible for:
- loss or damage that was not foreseeable;
- loss or damage caused by something outside our reasonable control, such as a failure of Apple's services, the internet or your device, as long as we take reasonable steps to limit the effect;
- business losses, because BrightNods is for domestic and private use.
12.5 Interruptions. We aim to keep BrightNods working well. Most of it works offline. Updates, Apple's services or iCloud can sometimes cause short interruptions. If a problem is our fault, 12.1 applies.
13. Changes to BrightNods
13.1 We update BrightNods to fix problems, improve it, add content, keep it secure, reflect changes to the curriculum, and meet new laws or Apple's rules. Updates are free and are delivered through the App Store.
13.2 An update will not stop BrightNods being of satisfactory quality, fit for purpose and as described.
13.3 If we plan to remove a main feature of Premium, or make a change that would make BrightNods significantly worse for you, we will tell you in the grown-ups' area at least 30 days before. You can then cancel Premium before the change, and if you have paid for a period after the change that you cannot use, you can ask Apple for a refund for that period, and we will support your request (section 5.8).
14. Changes to these terms
14.1 We may change these terms only for good reason: to reflect changes in the law or Apple's rules, changes to BrightNods or Premium, changes to how we provide the service, or to make them clearer.
14.2 We will show you the new terms in the grown-ups' area at least 30 days before a change takes effect, and say what has changed. If a change is to your disadvantage you can cancel Premium before it takes effect and you will not be charged at the new terms. If a change is significant we will ask you to agree to it; it will not apply to you just because you keep using the app. If you do not agree, you can end these terms (section 15.1) and you will not be charged under the new terms. Until you either agree or end these terms, the old terms continue to apply, and the grown-ups' area asks you again each time you open it. Your child's part of the app keeps working in the meantime.
14.3 Changes that do not affect your rights or what you pay (for example correcting typing errors or updating our contact details) may take effect when we publish them.
14.4 Every version has a number and date. Previous versions are kept at brightnods.co.uk/terms/archive/.
15. Ending these terms
15.1 You can end these terms at any time by deleting your account and the app. Remember to cancel Premium (section 5.5).
15.2 What happens to your information. When you delete your account, your family's information is deleted as the Privacy Notice explains. You can export it first.
15.3 Us. We may end these terms with you only if you seriously or repeatedly break section 10 (for example, by using BrightNods to harm a child), or if the law requires it. Except where there is an urgent risk to a child or the law prevents it, we will tell you why first and give you a chance to put it right. If we end these terms, you can ask Apple for a refund for any paid period you can no longer use, and we will support your request (section 5.8).
15.4 If we close BrightNods. If we stop providing BrightNods or Premium, we will tell you in the app at least 60 days before, stop new subscriptions and renewals, and you will not be charged for any period after it closes. If you have paid for a period you cannot use, you can ask Apple for a refund for it, and we will support your request (section 5.8). Before it closes you will be able to export your family's information.
16. Complaints and disputes
16.1 If you have a problem or a complaint, please email [[OWNER: support email]] with what went wrong and what you would like us to do. We will acknowledge it within 5 working days and aim to reply in full within 14 days. Concerns about family sharing are handled as section 10.6 explains. Data protection complaints are handled as the Privacy Notice explains (we acknowledge them within 30 days).
16.2 For problems with payments, renewals or refunds, Apple can help directly at reportaproblem.apple.com.
16.3 Alternative dispute resolution. We are not a member of an alternative dispute resolution (ADR) scheme, and no scheme is compulsory for our kind of business. When we give you our final answer to a complaint we will say so again. If we cannot settle your complaint, Citizens Advice (citizensadvice.org.uk, 0808 223 1133) or, in Scotland, consumeradvice.scot can advise you. You can also go to court (section 18).
17. Apple
These points are required by Apple for apps on the App Store. They do not reduce your rights under section 12.
17.1 Who this agreement is with. You and we both acknowledge that this agreement is made between you and us only, and not with Apple. We, not Apple, are solely responsible for BrightNods and its content. Nothing in this agreement sets usage rules for BrightNods that conflict with the Apple Media Services Terms and Conditions.
17.2 Licence. Your licence is set out in section 11. It is a non-transferable licence to use BrightNods on any Apple-branded products that you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions, except that BrightNods may also be used by other accounts associated with the purchaser through Apple Family Sharing, volume purchasing or Legacy Contacts.
17.3 Maintenance and support. We alone are responsible for providing any maintenance and support for BrightNods, as set out in these terms (section 19) or as the law requires. You and we both acknowledge that Apple has no obligation at all to provide any maintenance or support for BrightNods.
17.4 Warranty. We alone are responsible for any product warranties, whether express or implied by law, to the extent they are not effectively excluded; under UK law that includes the standards in section 12, which cannot be excluded. If BrightNods does not meet any warranty that applies, you can tell Apple, and Apple will refund the purchase price (if any) for BrightNods to you. To the maximum extent the law allows, Apple has no other warranty obligation at all for BrightNods, and any other claims, losses, liabilities, damages, costs or expenses caused by BrightNods not meeting any warranty are our sole responsibility. This does not reduce your rights against us under section 12.
17.5 Claims about BrightNods. You and we both acknowledge that we, not Apple, are responsible for dealing with any claim by you or anyone else about BrightNods or your having or using it, including: (i) product liability claims; (ii) any claim that BrightNods does not meet a legal or regulatory requirement that applies to it; and (iii) claims under consumer protection, privacy or similar laws, including in connection with BrightNods' use of Apple's HealthKit and HomeKit frameworks (BrightNods uses neither). Nothing in this agreement limits our responsibility to you beyond what the law allows.
17.6 Intellectual property. You and we both acknowledge that if anyone claims that BrightNods, or your having or using it, infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and resolving that claim.
17.7 Legal compliance. You promise that (i) you are not located in a country or region that is subject to a US Government embargo, or that the US Government has designated as "terrorist supporting"; and (ii) you are not on any US Government list of prohibited or restricted parties.
17.8 Our name, address and contact details. Questions, complaints or claims about BrightNods go to us: KINDHOME LTD, trading as BrightNods, 32 Mill Street, Worcester, WR1 2NH, telephone [[OWNER: phone]], email [[OWNER: support email]].
17.9 Other services' terms. When using BrightNods you must also follow the terms of any other service you use with it, such as your Apple Account, iCloud and your mobile or broadband provider's agreement.
17.10 Apple can enforce this agreement. You and we both acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this agreement, and that once you accept it, Apple will have the right (and will be treated as having accepted the right) to enforce it against you as a third-party beneficiary. No one else has any right to enforce it.
17.11 If Apple's standard EULA also applies. If for any reason Apple's standard Licensed Application End User License Agreement also applies to you, these terms take priority wherever they give you more rights, and nothing in it affects your rights under UK consumer law.
18. Which law applies, and courts
18.1 These terms are governed by the law of England and Wales.
18.2 You can bring legal proceedings about these terms in the courts of England and Wales. If you live in Scotland, you can bring proceedings in the Scottish courts, and if you live in Northern Ireland, in the courts of Northern Ireland. We will only bring proceedings against you in the courts of the part of the UK where you live.
18.3 Wherever you live in the UK, you keep the protection of the consumer laws of your home country that cannot be changed by agreement.
